The Cape Town-based law firm Richard Summers Inc. has been chosen by the West Coast Environmental Protection Association (WCEPA) to go to the High Court. This is to seek redress from the competing and contradictory judgments and orders issued by the two members of the Water Tribunal in its appeal against the decision of the South African Department of Water and Sanitation to grant a water use licence to Kropz Elandsfontein Ltd for its phosphate mine.
